Order of Inquest August 18th 1856
To the Honorable Judges of the Orphans Court of Montgomery County.
The Petition of Jesse B. Knipe, Frederick Knipe, Matthias Knipe, Conrad Knipe, Abigail intermarried with Samuel Fleck, Catharine intermarried with Jacob Heist, Margaret intermarried with Frederick Beaver, Phebe intermarried with John Swartley, Mary Ann Kline intermarried with Jonas Kline, all children of Frederick Knipe late of Towamencin Township deceased and also of John Barndts Guardian of Mahlon, Frederick and Elwood Barndt and Samuel Fleck guardian of Albert and John Barndt all Grandchildren of the said Frederick Knipe Sr. deceased.
Respectfully Represent:
That the said Frederick Knipe died intestate on or about the 5th day of March A.D. 1856 leaving surviving him a widow named Margaret and the following children viz: Jesse B. Knipe, Frederick Knipe, Matthias Knipe, Conrad Knipe, Abigail wife of Samuel Fleck, Catharine wife of Jacob Heist, Margaret wife of Frederick Beaver, Phebe wife of John Swartley, Mary Ann wife of Jonas Kline, and the following named grand children they being the children of Sophia who was intermarried with Levi Barndt & a daughter of said Intestate viz Mahlon, Albert, John, Frederick & Elwood all of whom are minors & have as their Guardian as above stated.
That the said Intestate died seized in his demesne as of fee of & in all the following .... real estate to wit-:- No. 1. All that certain Messuage or Tenement and tract of land situated in the Township of Towamencin & County aforesaid ...ting on the Allentown Road bounds upon another public road which leads on to Pawling's Bridge and adjoins lands of James Slough, Henry Cassel & Joseph Cassel being the same premises occupied by the same intestate at the time of his decease Containing Eighty-four acres of land more or less with the appurtenances.
No. 2. All that lot or piece of land situate in Gwynedd Township in the said County fronting in a public road & adjoining lands of Asa Thomas, Henry Durstine, & Joseph Bowes & contains six acres more or less with the appurtenances all of the same being wood land which is all the real estate of the said Intestate wherever situate & of whatever kind which has come to the knowledge of your petitioners.
Your petitioners therefore pray your Honors to appoint and order Jacob Pruner, Aljournal Jenkins, Christian Markley, John Martin, Asa Thomas, Henry Durstine, James Slough who are chosen by your petitioners for that purpose to make partition of the premises above mentioned & described as No. 1 to and among the children and representatives of the said Intestate in such manner & in such properties as by the laws of this Commonwealth is directed of such partitions can be made without prejudice to or spoiling the whole of said No. 1 above described but of such Partition cannot be made thereof as aforesaid there to value and appraise the same & make report of their proceedings herein according to Law. And they will pray.

County of Montgomery Frederick Knipe one of the petitioners above named being duly affirmed according to Law says that the above Petition is true to the best of his knowledge & belief & that all of the said Intestates children & representatives are named above & families that said real estate … any part thereof is required to pay the debt …. of said Intestate.

O.C. Judges all present- Aug 18, 1856 upon this …… of the within inquest & the Report of the .... therein being presented to the said Court & being read & duly considered the Court approve of said and confirms the same.
.... It appearing to the Court that Jesse B. Knipe eldest son of said decedent refuses to take any part of the real estate of said decedent. The second son to wit Frederick Knipe also appearing in Court elects to take the premises described as No. 2 at the .... thereof & offers Jacob Pruner & Christian Markley as his sureties who are appointed by the Court and Matthias Knipe third son of said decedent also appears in open Court& elects to take premises as described as No. 2at the sum of $55 per acre instead of $48 per acre as stated in the report of said inquest as per the partition to that affect filed herewith and the Court decree said premises described as No. 1 .... to said Matthias Knipe his heirs .... upon paying or securing to be paid according to law the sum of $55 per acre for said premises- No. 1 and the Court approve of the said Jacob Pruner and Christian Markley.
To the Honorable the Judges of the Orphans Court within named. We the subscribers appointed by the within order of the Court, to make partition of the real estate therein mentioned whereof the within named Frederick Knipe died seized, if such partition could be made without prejudice to or spoiling the whole, otherwise to value and appraise the whole.
Do report that in the pursuance of the said order, we have .... The lands and premises therein mentioned, having first been duly affirmed according to law, and finding that the same could not be parted and divided to among the parties interested within mentioned without prejudice to and spoiling the whole, but that the same as it is already divided, will conveniently accommodate two of the children or parties within mentioned of the said Frederick Knipe deceased, the two said parts being of unequal value as follows to wit.
Tract No. 1 Being a messuage or tenement and Ninety acres and six perches of land, with the appurtenances, situates in Towamencin Township, Montgomery County, and bounded and described within mentioned. We have valued and appraised at the sum of Forty Eight dollars per acre, amounting in the aggregate to the sum of Four thousand three hundred and thirty eight dollars. Tract No. 2 Being woodland containing Seven Acres and five perches of land, situated in Gwynedd Township in hence county, and more particularly mentioned and described within. We have valued and appraised at the sum of One hundred and twenty six dollars per acre, making the aggregate the sum of Eight hundred and eighty five dollars and ninety three cents; Witness our hands the Nineteen day of June A.D. One thousand eight hundred and fifty six.

In the matter of the valuation of Tract No. 2 of the Real Estate of Frederick Knipe, deceased.
Calculation of the Distribution
Whole amount of valuation of tract No. 2 is $885.93
The sum of $295.31 being the one third or widows dower of the said tract No 2 to remain in said lot No. 2 the interest thereof to be paid to Margaret Fleck widow of decedent annually during her life and the principle to be equally divided at her death among of Jesse B. Knipe, Frederick Knipe, Matthias Knipe, Conrad Knipe, Abigail intermarried with Samuel Fleck, Catharine intermarried with Jacob Heist, Margaret intermarried with Frederick Beaver, Phebe intermarried with John Swartley, Mary Ann Kline intermarried with Jonas Kline, all children of Frederick Knipe late of Towamencin Township deceased and also of John Barndts Guardian of Mahlon, Frederick and Elwood Barndt and Samuel Fleck guardian of Albert and John Barndt all Grandchildren of the said Frederick Knipe Sr. deceased.
Amount to be divided among the fourteen heirs- $590.62
$59.06 for each child and $11.81 for each grand child.

The sum of $1656.87 being the one third or widows dower of the said tract No. 2 to remain in said lot No. 2 the interest thereof to be paid to Margaret Fleck widow of decedent annually during her life and the principle to be equally divided at her death among of Jesse B. Was presented setting forth,
That the said Frederick Knipe died intestate on or about the 5th day of March A.D. 1856 leaving surviving him a widow named Margaret and the following children viz: Jesse B. And therefore praying the Court to appoint and award that you, who are indifferently chosen by the said Petitioners for that purpose, do make partition of the premises aforesaid with the appurtenances, to and among the said children, in such proportions as the intestate laws of this commonwealth are provided, &c.
We therefore authorize and empower you the said order Jacob Pruner, Aljournal Jenkins, Christian Markley, John Martin, Asa Thomas, Henry Durstine, James Slough to go to and upon the premises aforesaid, and that there, in the presence of the parties interested, if upon being warned they will be present, upon your oath or solemn affirmation, you make partition thereof to and among the children and legal representatives of the said Frederick Knipe deceased, in such manner and in such proportions as by the Laws of this commonwealth is directed, if such partition can be made without prejudice to and spoiling the whole; but if such partition cannot be made thereof as aforesaid, that you value and appraise the same according to law: and further, that you enquire and ascertain whether said real estate with the appurtenances, will conveniently accommodate more than one of the children of the said intestate, and if so, how many of the said children or legal representatives it will conveniently accommodate; and That you make return of your proceedings herein to the next general Orphans' Court to be held for the said county of Montgomery, according to law.

Settlement of the Estate of Frederick Knipe, the elder, deceased
Filed January 2nd 1858
The account of Frederick Knipe and Matthias Knipe, Administators which were of Frederick Knipe the elder, late of Towamencin. The said accountants charge themselves with the following items to wit. To the amount of inventory of the personal estate filed in the Registers office at Norristown in said County- $17, 948.32. To amount of interest accruing on bonds, mortgages and notes from date of inventory- $613.92. To an advance on the sale of goods- $76.31. To amount of rent due by Matthias Knipe-$35.00. Total amount $18,479.05.
There is an inventory and detailed sheet on the moneys owed in the estate papers. There are also diagrams of the land and boundaries.
