Petition of Jesse Gilbert for Inquest on Estate of Jonathan Gilbert

To the Honourable Judges of the Orphans Court of Montgomery County

The petition of Jesse Gilbert intermarried with Ann, late the widow of Jonathan Gilbert Respectfully represent

That said Jonathan Gilbert, late of Upper Dublin township Montgomery County, died intestate in or about the year One thousand and Eight hundred and twenty two, leaving a widow the above named Ann who is now the wife of Jesse Gilbert the petitioner, also leaving issue one child, to wit a daughter, Mary Ann: and died seized of a certain messuage and tract of land in Upper Dublin township Montgomery County aforesaid, Bounded by lands now owned by Charles Stout, John Clever, and George Shaffer and others, and containing about Seventy acres of land be the same more or less. That the daughter Mary Ann in the year one thousand Eigh hundred and forty three Married Reuben Frederick, and said Reuben and Mary Ann conveyed in the year one thousand Eigh hundred and forty four said estate subject to the widows dower to Clement Jones, and immediately said Clement Jones and Wife conveyed said estate back to said Reuben Frederick and Ann Frederick their heirs and assigns forever subject to the widows dower aforesaid.

That said Mary Ann the wife of said Reuben Frederick and daughter of said Jonathan Gilbert died intestate March 20th 1845 leaving no issue, but leaving a husband the above named Reuben Frederick, and leaving a mother the above named Ann wife of Jesse Gilbert the petitioner, and leaving no brothers or sisters, or neices (sic) or nephews of the whole or half blood, but leaving three uncles by the fathers side to wit, Charles, Israel and Jesse Gilbert and by the mother's side two uncles and one aunt to wit David Funk, Martin Funk, and Elanor (sic) interrmarried with John Wolf, said Eleanor Wolf. Reuben Frederick and Israel Gilbert, reside in the City or County of Philadelphia, the other named relatives and parties all reside in the county of Montgomery aforesaid.

No partition or valuation of said real estate having been had, nor any division between the widow and lineal descendants of said Jonathan Gilbert __ This petitioner therefore prays this court to award an inquest to make partition of the premises, aforesaid, to and among the representatives of said Jonathan Gilbert deceased in such a manner and in such proportions as by the laws of the Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole, but if such partition cannot be made thereof then to value or appraise the same, and make return of their proceedings according to law.
